Who owns a client's social media accounts?

Quick answer

The client should, always. Accounts, pages, and business manager assets belong to the client; the agency holds managed access that ends when the relationship does. Put it in writing at onboarding, create assets under the client's ownership, and never let an agency profile be the sole owner of a client's page.

This question usually arrives too late, during a breakup, when a client discovers their Instagram is tied to an agency's business manager or a former contractor's personal profile. The answer is simple and the discipline to enforce it early is what actually matters.

The principle

Social accounts are client property, part of their brand and their customer relationships. An agency operating them holds access, not ownership, in the same way a property manager holds keys rather than a deed. Agencies that hold accounts hostage in a dispute may win a short negotiation and lose their reputation, since the industry talks and the tactic is memorable.

Set it up correctly at onboarding

Create or claim assets under the client's ownership from day one: the client's Business Manager owns the pages and ad accounts, and the agency is added as a partner or admin. Where an agency created an account before this discipline existed, transfer ownership proactively rather than waiting to be asked. Connect through authorized platform connections so operational access never depends on who holds a password, and keep every asset traceable to a client-owned root.

Write it into the agreement

A short clause covers it: the client owns all social accounts, pages, and associated assets; the agency is granted access to manage them during the engagement; on termination, agency access is removed within a defined window and all account ownership remains with the client. Add a line about content ownership too, since who owns the produced creative is the second dispute that follows the first.

Offboarding cleanly is a marketing asset

When a client leaves, remove your access, confirm their ownership is intact, and hand over anything they need. Clean exits generate referrals and returning clients at a rate that surprises agencies who have only ever fought over accounts. The same hygiene that makes exits clean also makes staff departures uneventful.
